Any distributor/reseller with more than 10 employees who sells to customers in California must comply with California Proposition 65, which requires notices about potential exposure to certain chemicals.
Retailers are required to place a warning sign near displays of the listed products, and e-tailers must put a warning on their websites. The warning should read as follows:
⚠ /!\ WARNING: For California consumers. This product can expose you to chemicals including Cadmium and Mercury, which is known to the State of California to cause cancer, birth defects or other reproductive harm.
The warning message must be available to the individual prior to exposure.
This warning requirement applies to all sales to California residents and to products shipped into California. However, small businesses with less than 10 employees are exempt from the warning requirement of Proposition 65.
Our products are required to meet applicable federal standards for food safety. However, the materials used in printing the decorations found on the exterior of certain products may contain trace amounts of lead and cadmium, chemicals known to the State of California to cause birth defects or other reproductive harm. Any product with a California Prop 65 Warning falls into this category. Please note, the same product sold in or delivered to any other state is not required to maintain the warning.
